California Court refuses to review decision striking down voter-approved marriage amendment
SAN FRANCISCO, CALIFORNIA, June 6, 2012, ( LifeSiteNews.com ) – The Ninth Circuit Court of Appeals has declined to review a three-judge panel’s decision that California’s constitutional amendment defining marriage as the union between a man and a woman violates the U.S. Constitution . Tuesday’s ruling means the case will land before the U.S. Supreme Court . The Ninth Circuit panel came to the decision by a split, 2-1 vote. The dissenting opinion called the other two judges’ decree a “gross misapplication” of Supreme Court precedent “that would be unrecognizable to the Justices who joined it, to those who dissented from it, and to the judges from sister circuits who have since interpreted it.” A gay activist waves a rainbow flag in front of the 9th Circuit Court.
