A bill to allow for same sex marriage in South Australia is almost certain to face a High Court challenge even if it passes the parliament, its key backer says. Labor MP Susan Close, introduced the bill on Thursday, partly to mark the birthday of her brother who is gay. Should a personal moral agenda dictate  to the rest of the State? Do these politicians do any work, do they represent themselves or their community or their own biased opinions?

She strongly supports the reforms but concedes the issue will ultimately be determined by the courts. 'It's not a constitutional problem in the sense that it's perfectly okay for a state to have legislation relating marriage. The issue will only be if the High Court determines that the commonwealth has covered the field in defining marriage as between a man and a woman.
Labor MPs will be granted a conscience vote on the bill with Premier Jay Weatherill already declaring his support. Liberal MPs are expected to vote along party lines and oppose the legislation. Opposition justice spokesman Stephen Wade said it was beyond state parliament's authority to pass laws on gay marriage. 'Making laws for same-sex marriage in state parliament would be playing a cruel and misleading trick on those seeking marriage equality,' he said. 'We can't make laws about marriage at a state level because they would be declared unconstitutional.'Australian Marriage Equality South Australian convener Harley Schumann said the bill was an opportunity for SA to lead the way on important reform. Also supporting the process, Greens MP Tammy Franks called on the Liberal leader Steven Marshall to allow his MPs a conscience vote. 'Their claims that the law may be unconstitutional simply don't stand up to scrutiny,' Ms Franks said.
