Kentucky Senate and governor take up slack after AG abandons defense of marriage

FRANKFORT, KY , March 18, 2014 – Kentucky is shaping up to be new territory in the fight for marriage. On March 4, Kentucky Attorney General Jack Conway , a Democrat ,  said that he would not appeal  District Judge John Heyburn 's decision that the state should accept the “marriages” of four couples who were “wedded” in other states but live in Kentucky. This week, the state's governor formally appealed the decision to the 6 th   Circuit Court , days after hiring a private law firm to defend a state statute and a constitutional amendment , both defining marriage as between a man and a woman. Kentucky Gov. Steve Beshear Gov. Steve Beshear, who is a Democrat, disagreed sharply with the decision of Conway to not defend the state's 1998 law and 2004 constitutional amendment. FRANKFORT, KY , March 6, 2014– Pope Francis has unequivocally opposed same-sex “marriage.” As a cardinal he went so far as to call it a “machination of the Father of lies .” But that hasn’t stopped Catholic politicians from claiming him as their inspiration when they take part in overturning the traditional definition of marriage. Kentucky Attorney General Jack Conway , a Catholic Democrat, became the latest to do so when he  explained  to  Time  magazine this week his decision not to defend his state’s marriage laws after a federal judge ruled Kentucky must recognize out-of-state same-sex “marriages.” In the words of  Time : A Catholic and a Democrat considering running for governor in 2015, Conway said he knew the decision could put him at odds with voters and with church leaders in his hometown. Kentucky must recognize foreign gay ‘marriages’ at once, state AG may not defend law

FRANKFORT, KY , February 27, 2014 – A federal judge refused to grant a stay to his ruling that Kentucky must recognize same-sex “marriages” conducted in other states, or foreign countries. That means the traditional, religious state must treat such unions as  bona fide  “marriages” at once. U.S. District Judge John G. Heyburn II   made the initial ruling on February 12 . On Thursday, he issued a final order striking down parts of a state law and a state constitutional marriage amendment supported by a wide majority of the voters. Judge John G. Heyburn ruled that the measures “deny validly married same-sex couples equal recognition and benefits under Kentucky and federal law, those laws violate the Equal Protection Clause of the Fourteenth Amendment of the United States Constitution , and they are void and unenforceable."
