On April 5, 2007,  Time Magazine   asked  the question, “Should Incest Be Legal?” Three years later, when Columbia University professor David Epstein was arrested for a three-year, consensual affair with his adult daughter, his attorney  noted , “It’s OK for homosexuals to do whatever they want in their own home. How is this so different? We have to figure out why some behavior is tolerated and some is not.” Not surprisingly, some Columbia students asked why any sexual acts committed by consenting adults should be considered a crime. Today, that question is being asked again, this time in the context of a lawsuit  reported  by the  New York Post  on April 10. Incest laws could be scrapped in Germany after the government's ethics council said sex between brothers and sisters should be legal and is a 'fundamental right'. The council recommended that the right of 'adult siblings to sexual self-determination' was more important then the 'abstract idea of protection of the family'. It comes after the case of Patrick Stuebing, who was jailed for more than three years after having four children - two of which are disabled - with his sister Susan Karolewski. The German Ethics Council has suggested that sex between brothers and sisters should be legalised Stuebing was put up for adoption as a toddler and only met his sister when he was 24 and she was 16. He was imprisoned for incest in 2008. An Australian judge has been suspended from hearing criminal cases and is under investigation after complaints about his reported comments earlier this year that “incest is no longer taboo,” because of increased availability of abortion and contraception. The Sydney District Court judge aroused the backlash when he compared incest to homosexuality, saying that sexual contact between siblings and between adults and children are no longer seen as “unnatural” or “taboo.” Judge Garry Neilson said during a trial in April that just as homosexuality has been accepted since the 1950s, “a jury might find nothing untoward in the advance of a brother towards his sister once she had sexually matured, had sexual relationships with other men and was now ‘available’, not having [a] sexual partner.” The trial was of a man accused of having raped his sister in the 1970s and again in 1981. New Act leader Jamie Whyte has back-tracked on comments that incestuous relationships between consenting adults should not be illegal. Incest was disproportionately reported by both male and female bisexuals and homosexuals. 148 gays (7.7% of the sample) reported 14 (50%) of same-sex, and 7 (22%) of opposite-sex incestuous experiences, and 20 (69%) of same-sex and 2 (3%) of opposite-sex sexual experiences with other relatives. 88 lesbians (3% of the sample) reported 2 (33%) of same-sex incest and 7 (9%) of opposite-sex incest and 1 (17%) of same-sex and 10 (13%) of opposite-sex sexual experiences with other relatives. 12% of 98 male homosexuals vs 0.8% of 1,224 male heterosexuals with a brother reported brother-brother incest. One of these is thrust upon us by events in New York City , where a well-known Ivy League professor has been arrested for the crime of incest . What makes the question urgent is not so much the arrest, but the controversy surrounding it. David Epstein is a professor of political science at Columbia University , where his wife also teaches. He previously taught on the faculties of Harvard and Stanford. Last week, he was arraigned before a judge in Manhattan , charged with a single count of felony incest. According to authorities, Professor Epstein was for several years involved in a sexual relationship with his adult daughter, now age 24. Though the story was ignored by much of the mainstream media, it quickly found its way into the cultural conversation.
