Australia: Tasmania tussles over free speech debate - homosexual marriage

No sooner than the Tasmanian government tabled its planned changes to the state's anti-discrimination laws, came calls for the proposal to be scrapped . Amid much controversy, the Liberal administration on Tuesday in parliament put forward an amendment Bill, insisting free speech is a fundamental right . Attorney-General Vanessa Goodwin highlighted that the changes do not allow for hate speech but would enable church groups the right to convey their views on social issues such as same-sex marriage, without the fear of being reported to the anti-discrimination commissioner. "It is everyone's right to be able to genuinely participate in public debate and discussion, while ensuring that there are appropriate protections in place to stop people going too far," the minister said. Labor Premier Lara Giddings and her coalition partner, Greens leader Nick McKim , jointly guided a same-sex marriage bill through the lower house on Thursday. It was the first time that an Australian house of parliament had passed such a bill. This, said Ms Giddings, would erase Tasmania’s reputation as the “laughing-stock” of Australia. Mr McKim praised the bill even more rapturously: “Romans chapter 13, verse 10 says, ‘Love does no harm to its neighbour; therefore love is the fulfilment of the law’. We are here today to give full expression to love in the laws of our state.” Even though Tasmania is an island state with only half a million people, this is a significant event. NSW churches urge Premier to rule out gay marriage laws

The Council also sought confirmation from the Premier that, should a same-sex marriage bill be introduced by a private member or another political party, the bill would not be given priority and Coalition members would not be given a conscience vote. The move comes after Tasmanian Premier Lara Giddings announced on Sunday that her government would pursue legislative reform to allow same-sex marriage in Tasmania . The Prime Minister is again under pressure on the issue of gay marriage as the Labor Premier of Tasmania , Lara Giddings , said she would face down any constitutional challenge of proposed legislation for same-sex marriage in her state. The proposed Tasmanian legislation is a departure from Ms Gillard 's vocal political and personal opposition to same-sex marriage and yesterday she made it clear she considered gay marriage to be a federal concern. ''The Marriage Act is a federal law and we do have a bill before the federal Parliament dealing with same-sex marriage,'' the Prime Minister told reporters in Cairns . ''I determined that this should be a conscience vote for the Labor Party and people will be free to determine how they vote.'' "Same-sex marriage is an idea whose time has well and truly arrived, n ot to address this discrimination will diminish us as a nation, as a tolerant community." Image via Wikipedia TASMANIA, Australia , October 1, 2011  – Tasmania’s lower House of Assembly has become the first Australian parliament to pass a motion backing homosexual ‘marriage.’ The same-sex marriage  motion  that passed 13-9 on Sept 21 was put forward by Green leader and Education Minister Nick McKim . It called for “in-principle support for marriage equality” and for the Australian Government to amend the Commonwealth Marriage Act to include homosexual ‘marriage’ in the name of “marriage equality.” The motion is in conflict with Australia’s Marriage Amendment Bill of 2004, which states that,” Marriage means the union of a man and a woman to the exclusion of all others, voluntarily entered into for life.” The Marriage Bill also specifies that certain unions are not marriages and therefore cannot be recognized as such in Australia, including unions solemnized in foreign countries between two men or between two women.
