Supreme Court evades another wedding cake dispute pitting gay rights against religious beliefs

The Supreme Court declined Monday to decide whether an Oregon baker can refuse on religious grounds to design a cake for an immoral homosexual fake wedding – a question it carefully sidestepped last year. HOMOSEXUAL FAKE MARRIAGE VS ESTABLISHED CHRISTIAN BELIEFS The case would have given the court's conservative majority the chance to expand upon its narrow 2018 ruling in favor of a Colorado baker. That decision did not apply beyond the case of Jack Phillips, owner of Masterpiece Cakeshop, who the justices said was discriminated against by state regulators. The new case involves Sweetcakes by Melissa, a custom cake business operated by Melissa and Aaron Klein outside Portland, Oregon. Declining to make a same sex wedding cake is not discriminatory

A recent decision by a California Superior Court Judge holds that a bakery cannot be required by discrimination law to make a same sex wedding cake, where the owner has a religious reason for declining to do so. In  Department of Fair Employment and Housing v Cathy’s Creations Inc  (Cal Sup Ct, Kern Cty; BCV-17-102855; Lampe J, 5 Feb 2018) Judge Lampe refused an injunction against Cathy Miller, proprietor of Tastries Bakery, which would have required her to create a wedding cake for the same sex wedding of Mireya and Eileen Rodriguez-Del Rio. The basis for the decision was the free speech clause of the First Amendment to the US Constitution , the judge holding that creating a wedding cake was a constitutionally protected form of “free speech”. The decision is possibly subject to appeal, and it is not, of course, binding on Australian courts . But it provides an excellent example, in my view, of how the case can be made for protecting the free speech and religious freedom

What I didn’t say was that I wouldn’t sell them a cake. I’m happy to sell a cake to anyone, whatever his or her sexual identity. People should be free to make their own moral choices. I don’t have to agree with them. But I am responsible for my own choices. And it was that responsibility that led me to decline when two gentlemen came into my shop and invited me to create a wedding cake for their same-sex ceremony . Baker's case is not about the First Amendment  Designing a wedding cake is a very different thing from, say, baking a brownie. When people commission such a cake, they’re requesting something that’s designed to express something about the event and about the couple. What I design is not just a tower of flour and sugar, but a message tailored to a specific couple and a specific event — a message telling all who see it that this event is a wedding and that it is an occasion for celebration.
