Messy ACT Homosexual Marriage Law will bring confusion depending on which state you reside

The case is the first real test of whether or not states and territories can legislate for homosexual marriage. The logic that the ACT has presented would also allow in the future other creative relationship that mimic heterosexual marriage, such as bigamy.  Already the transcript of the hearing clearly portrays the mess that will be created if one territory is permitted to make it own laws like this. Australian homosexual couples have five days to “marry” with High Court’s “reserved” decision

CANBERRA,  – An Australian court has “reserved judgment” on whether a proposed law to allow “homosexual marriage” in one state is unconstitutional and has decided to wait until five days after it is to come into effect. Currently, federal law specifically bans “homosexual marriage” and a law proposing to allow it in the Australian Capital Territory (ACT) is scheduled go into effect on Saturday.  The High Court, that has the authority to strike down the law, said it would consider the case again on December 12th. The ruling came yesterday after the federal government told the court in Tuesday’s hearing that a change to the law to expand marriage to include homosexual partnerings is unconstitutional. The block against “homosexual marriage” at the federal level is due to wording placed into the Marriage Act by the Howard government in 2004 that defines marriage as only existing between one man and one woman. The ACT Government will introduce legislation during the spring sittings of the Legislative Assembly to establish the Territory Same-sex Marriage Act. Same-sex couples in the ACT have been able to register their civil partnership since 2008, and last year a bill was passed to reinstate legally binding ceremonies. But the ACT Government wants to go further and give full marriage equality to same-sex couples. The Federal Government argues it has the sole responsibility for marriage laws, but ACT Attorney-General Simon Corbell says he is confident the Territory has the authority to go further.
