Colorado Wedding Cake Baker wins before US Supreme Court

In  Masterpiece Cakeshop, Ltd v Colorado Civil Rights Commission , 584 U. S. ____ (2018) (June 4, 2018), the US Supreme Court by 7-2 overturned previous decisions against a Christian cake maker, Jack Phillips, who had declined to make a wedding cake for a same-sex wedding. While the basis of the decision of the majority is fairly narrow, the outcome is clearly correct, and even in the narrow reasons offered by Justice Kennedy, there are a number of important affirmations which support religious freedom. I have commented previously on cases which involve a claim that a cake maker or other “wedding industry professional” should not be allowed to decline to devote their artistic skills to the celebration of a relationship their religion tells them is wrong: see  here ,  here,    here,  here  and  here . But the  Masterpiece  decision is the first time such a case has made its way to the final appellate court in a common law jurisdiction, and for that reason is particularly impor

National Surveys Show Decline in Support for Same-sex 'Marriage' We reported last week about the phenomenal change in public opinion concerning the public's support for same-sex 'marriage' as documented by a national survey conducted by the Associated Press/Gfk . The AP/GfK survey found support for SSM down 6 points since April, and opposition up by 4 points — a combined 10 point swing in public opinion. Two other national polls have been released, both showing a similar trend. Ipsos/Reuters found in its most recent survey that 51% of adults support same-sex 'marriage,' down 3 points since April. And the latest Gallup poll showed support for same-sex 'marriage' at 58% with opposition at 40%. Spencer denied the bakery owner’s claim that he was exercising his freedoms of religion and speech when he told a gay couple he would not make their wedding cake . Spencer instead ordered him to “ cease and desist from discriminating” or face fines ranging from $50 to $500 per person per incident, according to the bakery owner’s attorney. This decision sends a boding message to other small businesses, especially those in the wedding industry such as florists, bakers , photographers, and event venues, putting them in a troubling standoff between freedom of religion and anti-discrimination laws. DES MOINES, Iowa , - An Iowa baker who politely declined to provide a wedding cake for two lesbians based on her Christian values may face legal action from the couple. Same-sex “marriage” was legalized in Iowa in 2009 by the state Supreme Court, and a 2007 state civil rights act disallows discrimination on grounds of sexual orientation in matters of employment, education, housing, and public accommodation. Victoria Childress On Tuesday KCCI 8 Des Moines  interviewed   Trina Vodraska and Janelle Sievers, who said they were “shocked” when a local wedding cake business owner declined to provide the confection for their ceremony. “It was degrading, you know, it was like she chastised us for wanting to do business with her,” said Vodraska.
