Obama-appointed federal judge says Ohio must recognize out-of-state same-sex ‘marriages’

CINCINNATI, OH , April 17, 2014 ( LifeSiteNews.com ) – On Monday, an Obama-appointed  federal judge ruled  that Ohio authorities must recognize same-sex “marriages” contracted outside the state. Ohio currently bans such unions. Judge Timothy Black additionally called the state’s marriage amendment, passed by a 62 percent majority in 2004, “unconstitutional” and “unenforceable.” However, Black’s decision would not overturn the state’s gay “marriage” ban. Judge Timothy Black Gay “marriage” supporters are hailing Black’s decision as a further step towards legalizing same-sex unions in Ohio.  Civil rights lawyer Al Gerhardstein praised Black’s ruling.  Gerhardstein has filed three gay “marriage” lawsuits in Ohio since June. "This is a great day for many Ohio families," Gerhardstein said. "Yesterday, they lived in a state that discriminated against them; today they live in a state that has declared them equal. Their marriages, the very foundations of their fa

Homosexuals don't want marriage: just a symbol to make them look equal

Gay Couple with child (Photo credit: Wikipedia ) Whatever same-sex marriage is, that’s not what gays are after. They are after a symbolic vehicle that can make them equal to people who can do something they cannot—procreate. The briefs filed in Hollingsworth v. Perry , the Supreme Court case on California's Proposition 8 , reveal something odd. Much of the debate over same-sex marriage has been a fight over metaphors. Can a same-sex couple mean the same thing as a man and a woman, even if the body parts are not identical? Can domestic partnerships mean “separate but equal” and embody a new Plessy v. Ferguson ? Is Proposition 8 analogous to “separate but equal”? Is gay the new black? Is California of 2008 a metonym for Virginia in the Loving case? Are gay couples the same thing as infertile straight couples? Is homophobia like Jim Crow? Humbug. Since California has domestic partnerships with all the same legal benefits as marriage for same-sex couples, the material difference

Virginia’s attorney general leaves marriage defenseless

February 25, 2014 ( BreakPoint ) - Imagine for a moment that someone sues you. You arrive in court, expecting your lawyer to defend your interests, only to hear him say that he disagrees with you and will now assist your adversary. There would be pandemonium. Your attorney would be relieved of his duties, and in all likelihood, face professional censure. Yet, something akin to this happened to the people of Virginia last week. It’s part of a trend that should trouble people regardless of their position on certain “hot-button” issues. On February 13, a federal district court judge in Norfolk struck down Virginia’s ban on same-sex marriage. Judge Arrenda Wright Allen ruled that the voter-approved amendment to the Virginia constitution violated the 14th Amendment ’s Equal Protection Clause . Allen wrote that “Government interests in perpetuating traditions, shielding state matters from federal interference, and favoring one model of parenting over others must yield to th

Oregon will not uphold the law and not defend state ban on gay marriage

Ellen Rosenblum accused of picking and choosing which laws to uphold and which laws to ignore. Either be impeached or the people call for her immediate resignation. Oregon will not defend a ban on gay marriage in the state, which was sued by four same-sex couples who argue the prohibition violates equality guarantees enshrined in the U.S. Constitution , the state's top law enforcement official said on Thursday. The decision by Attorney General Ellen Rosenblum to NOT uphold the law, makes Oregon the third state in the past month to illegally cease defense in federal court of gay marriage bans, after Nevada and Virginia , as activists fight for legalization across the United States . "The law in this area is developing, and it is now clear that there is no rational basis for Oregon to refuse to honor the commitments made by same-sex couples in the same way it honors the commitments of opposite-sex couples," Rosenblum, a Democrat, said in announcing the decision. But

Obama-appointed federal judge strikes down Virginia’s same-sex ‘marriage’ ban

NORFOLK, VA , February 14, 2014 ( LifeSiteNews.com ) – Yet another federal judge has  overturned  a state law banning same-sex “marriage,” as Judge Arenda Wright Allen declared Virginia’s law enshrining true marriage unconstitutional Thursday.  The state becomes the fourth to have a legislative or voter-approved measure banning gay marriage overturned by a federal judge. “The Court is compelled to conclude that Virginia's Marriage Laws unconstitutionally deny Virginia's gay and lesbian citizens the fundamental freedom to choose to marry,” Allen wrote in her  41-page decision , which  Mother Jones  called “incredibly moving.”  “Government interests in perpetuating traditions, shielding state matters from federal interference, and favoring one model of parenting over others must yield to this country's cherished protections that ensure the exercise of the private choices of the individual citizen regarding love and family.” “We have arrived upon another moment in

Nevada governor says he won’t defend state’s marriage amendment

CARSON CITY, NV , February 11, 2014 ( LifeSiteNews.com ) – On the heels of the announcement by Virginia's attorney general that he will not defend the constitutional amendment enshrining marriage as between a man and a woman, Nevada 's attorney general and governor are following suit. Approved by voters and added to the state constitution in 2002, the Nevada amendment (which can be seen in full  here ) has been challenged by eight same-sex couples. Nevada Attorney General Catherine Cortez Masto and Gov. Brian Sandoval , who defended the law just last month, had previously filed in support of the amendment in November 2012. Gov. Brian Sandoval However, Masto has now  declared  that since the 9 th   Circuit Court of Appeals has said sexual orientation cannot be the sole reason for taking potential jurors off of a jury, “the state has determined that its arguments grounded upon equal protection and due process are no longer sustainable.” Gov. Sandoval, who is seek
